You prepare your bid carefully, send it in on time and then the news arrives: the tender was declared void. Or worse, you find out that a process you were going to apply for ended with no award before you could take part. Far from being a final defeat, a void tender is a signal worth reading properly, because behind it there may be a real opportunity.
What a void tender is
A tender is declared void when the purchasing process ends with no award. That can happen for three main reasons: no bid was received within the deadline, the bids received did not meet the admissibility requirements set out in the specifications, or the admitted bids were not suitable for the public body (for example, because the prices exceeded the available budget). In any case, the result is the same: nobody takes the contract.
This declaration is formal and is recorded on the Mercado Público platform, so any supplier can see it. It is not administrative silence: the body must explicitly report that the process ended with no award.
Why it happens: the most common causes
- Requirements that are too demanding: specifications drafted with technical requirements, certifications or guarantees that are hard to meet for the suppliers available in the market.
- Very short deadlines: too little time to prepare a serious bid discourages participation, especially among smaller suppliers.
- Budget out of range: the available amount does not cover the real cost of the goods or service, and bidders cannot go lower without working at a loss.
- Poor circulation: some processes do not reach the right suppliers in the sector.
- Formal errors in the bids received: everyone who took part committed some failure that made them inadmissible.
The opportunity a void tender opens up
A void tender is, at bottom, an unmet demand from the State: the body needs those goods or that service, did not obtain them, and has to resolve it somehow. That gives you a window. What usually happens next is one of two things:
- The process is re-tendered: the body opens a new tender, often with adjusted specifications. Check whether they lower requirements, extend the deadline or increase the budget. The second round usually attracts fewer competitors than the first, which improves your chances.
- It is resolved by direct contracting: the Public Procurement Act allows the body to contract directly with a supplier when a previous tender was declared void, provided it justifies this with a reasoned resolution. If you are the only supplier able to deliver, or simply the best prepared, you could be the one chosen.
Both scenarios favour whoever was paying attention and did not give up when the process was declared void.
If your bid was ruled inadmissible
Sometimes the tender is declared void because every bid —including yours— was rejected for failing some formal requirement. That stings, but it is recoverable if you draw the right conclusions:
- Read the evaluation report: on Mercado Público the body must state why the bids were not admissible. Read it carefully; the root cause is there.
- Identify what was missing: it is almost always a missing document, a wrong format, or not being in good standing on ChileProveedores at the required moment.
- Adjust your checklist: add that requirement to your check list before the next bid. An administrative error should not happen twice.
- Prepare for the re-tender: if the process reopens, you will be ready to take part with the corrected bid.
How to make use of a void tender that was not yours
Monitoring processes declared void in your sector is a strategy few suppliers practise. Yet it is a valuable source of information:
- Confirmed demand: the body published a real need. Even though the process failed, the need did not go away.
- Less competition in the second round: many suppliers lose track when a process collapses; those who follow closely have an advantage.
- The possibility of direct contracting: if you are able to meet that need and make yourself available, you may be contacted directly, especially if the body cannot find easy options in the market.
To monitor them, use the Mercado Público search with the status filter "Desierta" within your category and region. It is public, free information.
In short
A void tender is not the end of the road: it is a sign that the demand exists but the process did not work. The body will have to resolve that need, either by re-tendering or through direct contracting. Whoever understands that, reviews their own mistakes if they made any, monitors how the process is reframed and stays available, has a real advantage over those who simply closed the listing and moved on to the next process.
